10. They put mcclain into a dangerous situation when there was blatantly obvious no probable cause existed. At the least. If they were ordinary citizens they would have been charged with 1st 2nd degree murder or voluntary manslaughter. The da knows this full well he knows he has a police bias full well and he should be fired obviously.

11. I think there would be a case for furst degree murder here. Premeditation. Deliberation. Malice aforethought. Strong evidence. Strong case. By the fact that there is no way in any legal encyclopedia or digest that there was any probable cause here. A mentally disabled kindergartner could see that the cop who used the chokehold held malice toward the victim. Fairly obvious. And they stopped him for one reason only. They were vindictive towards him. And you can tell when you watched the video these feelings of malice surged as the incident went on. The fact that the officer laughed about it proves he supported the death. Another indication of vindictiveness.even if he didnt give him the ketamine he ordered the other person to do it. There is enuf evidence the officer hoped it would kill the victim to charge him with premeditated murder. Just like the man that drives the getaway car while his cohort does the shooting theyre both responsible. Im not sure texas is fair but case after case the man who grabbed the loot wasnt even armed while the cohort did the killing ended up with the death penalty. Even in the case of the clutter murders one did all the killing robert blake charachter wouldnt it be easier to exonerate the scott wilson perpetrator an easier case to make than this cop even though he didnt administer the ketamine. Thats my claim. The ugliest thing about this is that in the case if the clutter murders if the daughter had exited her window hung and dropped like the fire dept teaches and ran to the hired hands house for help the second she put her jewelry in that sock when she heard voices she could have saved her family. Elijah never stood a chance as soon as he walked down a public street.

38. Ketamine is used in EMS applications daily with no incident. Ketamine is used in place of opiate narcotic pain meds like fentanyl and morphine and is deemed to be much safer and doesn’t have the penchant for causing respiratory depression like opiates do.

    Horribly unfortunate situation though, and he should never have been accosted to begin with.
