The money is repayment of a loan. If I understand correctly entering that expense as a legal expense and not as repayment of a loan is a misdemeanor. If that expense was then deducted from profits on the tax returns, would that not be a second crime causing it to become a felony? Would it not be easier proving tax fraud?

Trump's attorney made the decision to be in Trump's defense, right or wrong he made his own choice. I personally think he made a big mistake by taking that big profile case as is Trump's. He risked everything on one hand. Trump is bad business all the way around and when he falls he will bring everyone with him. When one deals with dirt and corruption one will get dirty and corrupted as well. One thing I feel sorry for but not much about is how frustrating must be to work for an unruly client, who is never wrong, and has total disregard for any authority. Something has got to give some time and that is why he explodes at the minimum! I wonder how his home life is after a day's work with the Trump!

If Trump doesn't use email, Cohen would have had to convey at the blackmail was successful, and as a personal lawyer he would have told her personally – I doubt through an intermediary as that would have increased the number of people who knew about the pay-off unnecessarily.
